Abstract

Style embodies originality, particularly in the realm of fashion, where it represents a distinctive look achieved through cosmetics, accessories, apparel, or other mediums. The fashion industry has grown into one of the most significant industries globally, driven by fierce competition and the desire to stand out. In today’s fast-paced world, individuals often use fashion as a tool to express their individuality and differentiate themselves from the crowd. The unique nature of fashion, rooted in human creativity and imagination, demands protection from potential exploitation. Given the rapid evolution of the industry, safeguarding these innovations is essential. The fashion industry is growing daily, with endless possibilities for designers. India, in particular, has emerged as a key global market for fashion merchandise, reflecting its expanding consumer base and creative potential. However, despite the industry’s importance, India lacks specific legal provisions that offer comprehensive protection for fashion. Intellectual Property Rights (IPRs) provide some level of security for a designer’s original creations, but they often fall short of providing sufficient protection in this dynamic and diverse sector. While IPRs can help shield designs from theft or unauthorized use, the fashion industry faces unique challenges that these laws do not fully address. Designers frequently encounter issues such as copying, counterfeiting, and a lack of enforcement, making it difficult to protect their intellectual property adequately. This article will explore the necessity of stronger protections for India’s fashion industry and provide a detailed analysis of the current intellectual protection for original fashion sketches and designs, ensuring that creativity is not compromised in the fast-paced world of fashion.
